2.1. The Supplier will verify any inquiry within 48 hours, arrange a date for a site
inspection in order to prepare a quotation, and will communicate to the Customer
potential start dates, estimated completion, and payment method. The Supplier has
up to 48 hours to quote the final purchase price (including material and labour costs).
3. PURCHASE ORDER
The Customer may email, phone, or place a purchase order either in person at the
Supplier's location or at another previously agreed location. Purchase orders are
mandatory for any agreement and comply with applicable laws.
3.1. Each purchase order has the Customer’s full name, delivery and billing address,
phone number, email, and, for individuals or corporations: Company Registration
Number (CRN), VAT Identification Number, service name, and quantity (if
applicable).
This information will be used solely in the business relationship between the Supplier
and the Customer. None of this information will be shared with third parties, unless
where necessary for product delivery, in which case it may be shared with carriers.
3.2. All purchase orders received by the Supplier are entered in the Supplier’s system
and, upon their registration, will establish a business relationship between the
Supplier and the Customer.
3.3. By confirming the PO, the Customer acknowledges and agrees to all provisions
of these General Terms and Conditions and accepts the agreed price for the ordered
service. Ownership of the materials used for the service passes to the Customer
upon payment.
4. DELIVERY CONDITIONS
4.1. Delivery times for any goods requiring shipping may vary. The Customer will
receive confirmation of the delivery date once the purchase order has been verified.
The delivery date for goods requiring shipping will always be communicated to the
Customer upon confirmation of the purchase order.
5. PRICE, PAYMENT TERMS, AND SHIPPING
5.1. Rates set for services are posted at the Supplier’s locations. These are subject
to change and the Supplier reserves the right to adjust them based on updated prices
and other information from manufacturers or suppliers. The final price will be
confirmed when the purchase order is verified.
5.2. Payment may be made either in cash or by bank transfer to the Supplier’s
account.
6. ACCEPTANCE OF GOODS
6.1. The Customer agrees for goods requiring delivery to accept them on the date
and at the address stipulated in the purchase order.
6.2. The Customer should always inspect any shipment for physical integrity and
completeness upon receipt of goods. Should the shipment or individual goods therein
be visibly damaged or destroyed, the Customer shall immediately contact the
Supplier and complete a damage report with the shipping company. No later claims
regarding quantity or physical damage will be accepted.
6.3. The Supplier is entitled to request fulfilment of obligations, including payment for
goods received, regardless of whether ownership of them has passed to the
Customer or not.
6.4. Risk of damage to the goods passes to either the Customer or their authorized
representative when they have been accepted.
7. WARRANTY AND REPAIRS (TN: added for more clarity)
7.1. Specific warranty and repair terms are outlined in the warranties for selected
goods, which the Customer will receive upon purchasing the goods. The same
applies to materials installed at the Customer’s location.
7.2. Unless indicated differently in the warranty, the period is specified in consumer
contracts as at least 24 months. For the purposes of any particular warranty,
“Customer” means an individual acting outside the scope of their business or
commercial activities.
7.3. Warranty claims are applicable only for goods purchased from the Supplier for
which the Supplier has received payment. The warranty will be void if the defect
results from mechanical damage, improper use, non-compliance with relevant
standards, unqualified installation, or if unauthorized persons have modified the
product. Warranties do not cover defects caused by natural disasters or improper
handling.
7.4. To initiate a warranty claim, the Customer should phone the Supplier to report
the defect and its details. The Supplier will then provide guidance on the next steps
based on the information the Customer provides.
8. FINAL PROVISIONS
8.1. The Supplier reserves the right to change prices and will notify the Customer of
any change. The Customer has the option of cancelling the purchase order if a price
is adjusted.
8.2. The Customer declares that they have read these General Terms and Conditions
and has agreed to them before either submitting a purchase order or notifying the
Supplier that a purchase order will be submitted.
8.3. Regardless of other provisions in the agreement, the Supplier is not liable to the
Customer for lost profits, loss of opportunities, or any other indirect or consequential
losses resulting from negligence, breach of contract, or any other cause.
8.4. These General Terms and Conditions have been drafted and are established in
good faith to comply with legal requirements and provide assurance of fair business
relationships between the Supplier and the Customer. Should any provision of these
terms be found invalid or unenforceable by the competent authorities of the Slovak
Republic, either partially or in full, such action shall not prejudice the validity and
enforceability of the remaining provisions and they remain unaffected.
8.5. The Customer’s rights as a consumer within the meaning of the Consumer
Protection Act 634/1992, as amended, shall be without prejudice to these Terms and
Conditions. Legal relationships and conditions not explicitly addressed herein, as well
as any disputes arising from failure to comply herewith, are governed by the relevant
provisions of the Commercial Code or the Civil Code.
8.6. The Supplier and the Customer agree to fully recognize remote communication
—via telephone including handwritten purchase orders and electronic communication
(particularly email and other internet communication) — as valid and binding for both
parties.
8.7. All personal data the Customer provides in the purchase order will be collected,
processed, and stored in compliance with Act 18/2018 on Personal Data Protection.
By submitting a purchase order or entering into a purchase agreement, the Customer
grants to the Supplier consent to process, collect, and store their personal data for
the purpose of concluding the purchase agreement, processing purchase orders, and
of related communication with the Customer. The Customer has the right to access,
correct, and exercise other legal rights related to their personal data.
8.8. The Supplier does not provide, disclose, or make the personal data of buyers
accessible to any third party, except to companies responsible for the delivery of
goods. Personal data will be shared with these companies only to the extent
necessary for delivery purposes.
8.9. Consent to process personal data and send commercial information is granted
for an indefinite period and may be revoked at any time free of charge through a
written, explicit request addressed to the Supplier by post, phone, or email at
info@eu-tech.sk.
8.10. The Customer is entitled to request rectification by the Supplier were they
dissatisfied with how the Supplier handled their complaint or if they believe the
Supplier to have violated their rights.
